The Treat Accessibly Halloween Streets Program recognizes and supports neighbourhoods that are committed to making Halloween more welcoming, accessible and inclusive for children of all abilities.

Each year, Treat Accessibly selects neighbourhoods across Canada that demonstrate community spirit and a shared commitment to creating an accessible trick-or-treating experience. Selected streets receive program resources, recognition and support to help bring that vision to life.

How It Works

Nominate Your Street

A homeowner or resident of the street registers to become the Street Captain and submits a nomination on behalf of their street.

The Street Captain acts as the primary contact with Treat Accessibly and helps coordinate participation with neighbours. The Street Captain can elect to receive support from neighbours on the street.

Streets Are Selected

Treat Accessibly reviews nominations from across Canada and selects participating streets based on factors such as, but not limited to, community participation at Halloween, accessibility, homeowners on the street that have registered to participate and geographic representation.

Because the Program is curated, submitting a nomination does not guarantee selection.

Invite Your Neighbours

For your street to be selected, the Street Captain invites neighbours to register their homes as participants.

Each participating household agrees to create an Accessible Treat Station and follow the Program guidelines.

Receive Program Support

Selected streets receive Program Support that may include:

Reimbursement for eligible Halloween treats purchased at Canadian Tire (up to a max of $1,000 CAD in Electronic Transfer per participating street); proof of purchase required for reimbursement.
Access to Treat Accessibly Lawn Signs at local Pet Valu Family of Stores locations to be placed on the front lawns of all homeowners participating up to 2 weeks in advance of Oct. 31.
Treat Accessibly signage and promotional materials;
Social media recognition and promotion;
Communications support; and
Other resources that may be available through the Program.

Celebrate Halloween

On Halloween, participating homes welcome trick-or-treaters by creating an experience that is:

accessible;

welcoming;

inclusive;

respectful;

starts 1 hour+ before sunset and

young family-friendly.

Together, participating neighbours help ensure more children can experience the joy of Halloween.

What We Ask of Participants

Street Captains and participating households agree to:

follow the Treat Accessibly Program Guidelines;
create a safe and welcoming experience for all visitors;
communicate with Treat Accessibly throughout the Program;
use Program Materials appropriately;
submit reimbursement documentation (where applicable); and
help promote the spirit of accessibility and inclusion within their community.

Important Things to Know

Participation is voluntary.
There is no cost to nominate or participate.
The Program is not a contest or lottery.
Selection is made at Treat Accessibly's discretion.
Program Support is subject to available funding and Program requirements.
Participants are responsible for their own property and Halloween activities.

Official Terms and Conditions

These Official Terms and Conditions ("Terms") govern participation in the Treat Accessibly Halloween Streets Program (the "Program"), operated by PADULO X INC., operating as Treat Accessibly ("Treat Accessibly", "we", "our" or "us").

By submitting a nomination, accepting selection, or otherwise participating in the Program, each Street Captain and participating homeowner agrees to be legally bound by these Terms. If you do not agree to these Terms, you may not participate.

1. Program Purpose

The Treat Accessibly Halloween Streets Program (the “Program”) is a national community initiative established by Treat Accessibly to recognize and support neighbourhoods that demonstrate leadership in making Halloween more accessible, welcoming and inclusive for children of all abilities.

The Program recognizes and supports streets that demonstrate leadership in accessibility, inclusion and community participation by encouraging participating households to establish Accessible Treat Stations and promote an inclusive Halloween experience within their neighbourhood.

The Program is intended to inspire broader community awareness and participation by showcasing leading examples of accessible trick-or-treating that other communities can adopt and replicate.

The Program is a discretionary community recognition initiative and is not a contest, sweepstakes, lottery, game of chance or prize promotion. No purchase is necessary to participate, and submitting a Nomination does not create any right, entitlement or expectation of Selection, Program Support or reimbursement.

Treat Accessibly reserves the right to establish, modify or discontinue the Program, its requirements, participation criteria and available Program Support at any time in accordance with these Terms.

2. Headings

The section headings in these Terms are included for convenience only and shall not affect the interpretation of these Terms.

3. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

"Captain" or "Street Captain" means the individual who nominates or represents a Participating Street, serves as the primary liaison with Treat Accessibly, coordinates participation among homeowners, and is responsible for fulfilling the obligations assigned to a Street Captain under these Terms.

"Founding Family" means the founders of Treat Accessibly, acting on behalf of PADULO X INC., who oversee and administer the Program and exercise the discretion granted under these Terms.

"Homeowner Participant" means an eligible homeowner or resident who registers to participate in the Program by operating an Accessible Treat Station at their residence on a Participating Street.

"Nomination" means the submission of an application or expression of interest requesting that a street be considered for participation in the Program. A Nomination does not create any right, entitlement or expectation of selection.

"Participating Home" means a residence located on a Participating Street whose occupant has agreed to participate in the Program and comply with these Terms.

"Participating Street" means a street or neighbourhood block selected by Treat Accessibly to participate in the Program.

"Participant"

You repeatedly refer to "participant" in the singular, but the defined parties are Street Captains and Homeowner Participants.

"Program" means the Treat Accessibly Halloween Streets Program, including all related activities, communications, materials, promotional initiatives, reimbursement programs, and support provided by Treat Accessibly.

"Accessible Treat Station" means a treat distribution location established by a Homeowner Participant that complies with the accessibility guidelines, standards or requirements published by Treat Accessibly from time to time.

"Program Materials" means all signage, lawn signs, logos, graphics, promotional materials, educational resources, digital assets, social media content, templates, guides, and other materials provided by Treat Accessibly for use in connection with the Program.

"Program Support" means any financial reimbursement, gift cards, treats, promotional materials, signage, recognition, advertising, communications support, or other assistance that Treat Accessibly may provide to selected Participating Streets in its sole discretion.

"Released Parties" means Treat Accessibly, PADULO X INC., the Founding Family, Program sponsors, partners, affiliates, successors, assigns, officers, directors, employees, contractors, volunteers, representatives, agents and their respective insurers.

"Selection" means the decision by Treat Accessibly, made in its sole and absolute discretion, to invite a nominated street to participate in the Program. Selection is not a prize, award or entitlement and may be revoked in accordance with these Terms.

"Sponsors" means the organizations, businesses and funding partners that provide financial, promotional, product or other support for the Program but do not administer or operate the Program.

"Terms" means these Official Terms and Conditions, as amended from time to time.

"Treat Accessibly", "we", "our", or "us" means PADULO X INC., carrying on business as Treat Accessibly, together with its authorized representatives administering the Program.

4. Eligibility

To be eligible to participate in the Program, a Street Captain must:

be the age of majority in the province or territory in which they reside;
be a legal resident of Canada, excluding the Province of Quebec, unless otherwise determined by Treat Accessibly;
reside on the street being nominated for participation in the Program;
submit a complete and accurate Nomination in the manner prescribed by Treat Accessibly;
agree to comply with these Terms and all applicable federal, provincial and municipal laws, regulations and bylaws;
serve as the sole Street Captain for the nominated street, unless otherwise approved in writing by Treat Accessibly; and
provide any information or documentation reasonably requested by Treat Accessibly to verify eligibility or administer the Program.

Homeowner Participants must reside on a Participating Street, accept these Terms prior to participating in the Program, and comply with all applicable Program requirements.

Treat Accessibly reserves the right, in its sole and absolute discretion, to determine participant eligibility at any time before or during the Program and may disqualify any individual or Participating Street that does not satisfy these eligibility requirements or otherwise fails to comply with these Terms.

5. Selection

5.1 Selection Process

The Treat Accessibly Halloween Streets Program is a curated community initiative designed to recognize and support neighbourhoods that demonstrate leadership in creating safe, welcoming and accessible trick-or-treating experiences for children of all abilities while inspiring broader community participation across Canada.

Participation in the Program is by invitation only. Selection is not determined by chance, random draw, scoring system, contest, sweepstakes or lottery. Treat Accessibly will review all eligible Nominations and select Participating Streets based on its assessment of each street's ability to support the objectives of the Program.

5.2 Selection Criteria

Without limiting Treat Accessibly's discretion, Selection may be based on one or more of the following considerations:

the demonstrated commitment of the Street Captain;
the anticipated level of homeowner participation;
the number of participating households, based on the individual online registration of households on the street that follow the steps requested by the Street Captain to register;
The accessibility readiness of the Participating Street;
the anticipated number of trick-or-treaters;
geographic diversity and community representation;
the overall suitability of the Participating Street to serve as a model for accessible trick-or-treating; and
any other factors Treat Accessibly considers relevant to the successful administration of the Program.

These criteria are intended as general guidelines only and do not limit Treat Accessibly's discretion.

5.3. Sole Discretion

All Selection decisions are made by Treat Accessibly in its sole and absolute discretion. Treat Accessibly reserves the right to accept or decline any Nomination, request additional information, select fewer or more Participating Streets than originally anticipated, revoke or withdraw a Selection, and make any other decision reasonably necessary to administer the Program. Treat Accessibly is under no obligation to provide reasons for any Selection decision.

5.4. No Entitlement

Submitting a Nomination does not create any right, entitlement or expectation of Selection, Program Support or reimbursement. Selection constitutes an invitation to participate in the Program and remains conditional upon confirmation of eligibility, acceptance of these Terms, continued compliance with all Program requirements, and any additional conditions established by Treat Accessibly. Failure to satisfy these conditions may result in the withdrawal of the selection without liability to Treat Accessibly.

6. Program Obligations

Participation in the Program is voluntary. However, once a Participating Street accepts Selection, the Street Captain and each Homeowner Participant agree to fulfill the obligations set out below throughout the Program.

6.1 Street Captain Responsibilities

The Street Captain shall:

act as the primary point of contact between Treat Accessibly and the Participating Street;
use reasonable efforts to recruit and encourage participation from eligible households on the Participating Street, for example: email, flyers dropped off at home, going door to door to speak about the movement – recruiting neighbours to support these steps;
distribute Program Materials, communications and updates provided by Treat Accessibly to participating households;
encourage participating households to meet any minimum participation targets established by Treat Accessibly from time to time;
coordinate Program activities on the Participating Street in a safe, respectful and inclusive manner;
promptly notify Treat Accessibly of any material change that may affect the Participating Street's ability to participate in the Program;
where Program Support includes reimbursement for treat purchases, administer such funds in accordance with these Terms, maintain accurate records, and submit receipts or other documentation reasonably requested by Treat Accessibly; and
comply with all reasonable instructions issued by Treat Accessibly relating to the administration of the Program.
The Street Captain agrees to use reasonable efforts to participate in media interviews, promotional activities and community outreach relating to the Program, provided reasonable notice is given. The Street Captain is not required to provide interviews but acknowledges that Treat Accessibly may identify the Participating Street publicly and may introduce the Street Captain as the primary media contact where the Street Captain has agreed to do so.

6.2 Homeowner Participant Responsibilities

Each Homeowner Participant shall:

register their home is participating online in accordance with the direction and website provided, by the Street Captain
establish and maintain an Accessible Treat Station at their residence that complies with the accessibility criteria published by Treat Accessibly;
display Program signage or other approved Program Materials provided by Treat Accessibly, where applicable;
welcome all trick-or-treaters in a respectful, inclusive and family-friendly manner;
conduct themselves safely and comply with all applicable federal, provincial and municipal laws, regulations and bylaws;
use Program Materials solely for the purposes of participating in the Program;
promptly notify the Street Captain if they are unable to participate as planned; and
refrain from any conduct that could reasonably harm the reputation, integrity or objectives of Treat Accessibly or the Program.

6.3 General Participant Obligations

All participants shall:

participate in good faith and in a manner consistent with the objectives of promoting accessibility and inclusion;
provide information that is complete and accurate;
cooperate with Treat Accessibly in the administration of the Program;
permit Treat Accessibly to identify the Participating Street in Program communications, promotional activities and community awareness initiatives, subject to these Terms;
obtain any permissions that may reasonably be required from property owners, occupants or other persons participating in activities associated with the Program; and
comply with these Terms and any Program policies, guidelines or instructions issued by Treat Accessibly from time to time.

7. Failure to Comply

Failure by a Street Captain or Homeowner Participant to comply with these Program Obligations may result in action by Treat Accessibly, including suspension, termination, withdrawal of Program Support or removal from the Program.

8 Termination

8.1 Termination by Treat Accessibly

Treat Accessibly may, at any time and in its sole and absolute discretion, suspend, revoke or terminate the participation of any Street Captain, Homeowner Participant or Participating Street, with or without notice, where Treat Accessibly determines that:

the participant has breached these Terms;
the participant has provided false, misleading or incomplete information;
the participant no longer satisfies the Program's eligibility or participation requirements;
the participant engages in conduct that may harm the reputation, integrity, objectives or safe operation of the Program or Treat Accessibly;
continued participation is no longer in the best interests of the Program; or
any other circumstance arises that Treat Accessibly reasonably determines warrants termination.
funding is no longer available or the Program is modified, suspended or discontinued.

8.2 Voluntary Withdrawal

A Street Captain or Homeowner Participant may withdraw from the Program at any time by providing notice to Treat Accessibly or, where applicable, to the Street Captain.

Where a Participating Street is unable to continue participating, Treat Accessibly may, in its sole discretion, withdraw Selection, discontinue Program Support, or take any action reasonably necessary to administer the Program.

8.3 Effect of Termination

Upon termination or withdrawal:

all rights to participate in the Program immediately cease;
the participant shall immediately discontinue use of all Program Materials except where otherwise authorized in writing by Treat Accessibly;
Treat Accessibly may cancel, reduce or withhold any unpaid Program Support or reimbursement;
Treat Accessibly may require the return or destruction of Program Materials where appropriate; and
any provisions of these Terms that by their nature are intended to survive termination, including without limitation Intellectual Property, Participant Content, Media Release, Privacy, Release of Liability, Indemnification, Limitation of Liability and General Provisions, shall remain in full force and effect.

Termination shall not affect any rights or remedies accrued prior to the effective date of termination.

9. Program Support and Reimbursement

9.1 Program Support

Selected Participating Streets may be eligible to receive Program Support to assist in delivering an accessible Halloween experience within their community. Program Support may include, without limitation, reimbursement for eligible treat purchases, promotional materials, signage, recognition through Treat Accessibly communications, paid social media promotion, or other support determined by Treat Accessibly.

Program Support is provided solely to assist in the delivery of the Program. It is not a prize, award, grant, employment benefit, charitable donation to participants, or other form of compensation, and has no cash value except as expressly provided by Treat Accessibly.

Treat Accessibly reserves the right, in its sole discretion, to determine the nature, amount, timing and method of providing any Program Support and may modify, reduce, substitute or discontinue Program Support at any time.

9.2 Treat Reimbursement

Subject to these Terms, eligible Participating Streets may receive reimbursement of up to a maximum of One Thousand Dollars (CAD $1,000) in the Electronic Transfer for approved treat purchases made at Canadian Tire in connection with the Program.

Reimbursement is subject to all of the following conditions:

the Participating Street has been formally selected by Treat Accessibly;
the Street Captain and participating homeowners have accepted these Terms;
purchases have been made solely for the purposes of the Program;
original receipts and any supporting documentation requested by Treat Accessibly have been submitted within the required timeframe;
Treat Accessibly has verified compliance with these Terms and the Program requirements; and
sufficient Program funding remains available.

Reimbursement shall not exceed the maximum amount approved by Treat Accessibly for the Participating Street, regardless of actual expenditures incurred.

9.3 Reimbursement Process

Unless otherwise communicated by Treat Accessibly, the Street Captain shall purchase eligible treats from an authorized Canadian Tire retail location using their own funds.

Following the purchase, the Street Captain shall submit copies of all receipts in the manner prescribed by Treat Accessibly.

Upon approval, Treat Accessibly will reimburse the approved purchase amount by Electronic Transfer or another reimbursement method determined by Treat Accessibly in its sole discretion.

Treat Accessibly reserves the right to reject any reimbursement request that is incomplete, submitted after the required deadline, contains ineligible purchases, or otherwise fails to comply with these Terms.

9.4 No Entitlement

Participation in the Program does not create any entitlement to Program Support or reimbursement.

Treat Accessibly may withhold, reduce, suspend or cancel any Program Support or reimbursement where:

a participant breaches these Terms;
Program requirements are not satisfied;
receipts or documentation are incomplete or inaccurate;
a Participating Street withdraws or is removed from the Program;

Treat Accessibly's decisions regarding eligibility for Program Support and reimbursement are final and binding.

Program Support and reimbursement are non-transferable, may not be exchanged for cash, assigned or sold, and may not be combined with any other Treat Accessibly funding unless expressly authorized in writing.

10. Intellectual Property

10.1 Ownership

All right, title and interest in and to the Program, including without limitation the Treat Accessibly name, Halloween Streets Program, logos, trademarks, service marks, slogans, designs, graphics, photographs, videos, written materials, educational resources, signage, digital assets, website content, social media content, Program Materials and all related intellectual property (collectively, the "Program Intellectual Property"), are and shall remain the exclusive property of Treat Accessibly, PADULO X INC., or their respective licensors.

Nothing contained in these Terms transfers or grants any ownership rights in the Program Intellectual Property to any participant.

All goodwill arising from use of the trademarks belongs exclusively to Treat Accessibly.

10.2 Limited Licence

Subject to these Terms, Treat Accessibly grants participating Street Captains and Homeowner Participants a limited, non-exclusive, non-transferable, revocable licence to use the Program Materials solely for the purpose of participating in the Program and only during the applicable Program period.

Participants shall not modify, reproduce, distribute, publish, sell, sublicense, create derivative works from, or otherwise use any Program Intellectual Property except as expressly authorized in writing by Treat Accessibly.

10.3 Restrictions

Participants shall not:

use the Treat Accessibly name, logos or trademarks in any manner that suggests sponsorship, endorsement or affiliation beyond participation in the Program;
use Program Materials for commercial purposes, fundraising activities unrelated to the Program, political activities or personal financial gain;
alter, remove or obscure any copyright, trademark or proprietary notices appearing on Program Materials; or
register, apply to register, or otherwise claim ownership of any intellectual property that is identical or confusingly similar to the Program Intellectual Property.

10.4. Participant Content

Where a participant voluntarily submits photographs, videos, testimonials, stories, social media posts or other content relating to the Program ("Participant Content"), the participant retains ownership of such content.

By submitting Participant Content to Treat Accessibly, the participant grants Treat Accessibly and its authorized partners a perpetual, worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, publish, distribute, display, adapt and promote such Participant Content in connection with the Program, Treat Accessibly's charitable mission, marketing, communications, reporting and future promotional activities, without further notice or compensation, unless otherwise required by law.

Participants represent and warrant that they own or have obtained all necessary rights and permissions required to submit Participant Content and grant the licence described in this Section.

10.5. Survival

The rights and obligations contained in this Section shall survive the conclusion, cancellation or termination of a participant's involvement in the Program.

11. Media Release and Publicity

11.1 Consent to Publicity

By participating in the Program, each participant consents to Treat Accessibly photographing, filming, recording and otherwise documenting their participation in the Program.

Subject to applicable law, participants grant Treat Accessibly, PADULO X INC., the right to use the participant's name, first name, municipality, likeness, image, voice, photographs, video recordings, testimonials, quotations and other information relating to their participation (collectively, the "Publicity Materials") for the purposes of administering, promoting and reporting on the Program. Participants waive any right to inspect or approve final materials.

11.2 Permitted Uses

Publicity Materials may be used in any media now known or later developed, including, without limitation: websites; social media platforms; digital and print advertising; news releases; media interviews; promotional campaigns; educational materials; sponsor recognition; public relations activities; and other communications relating to Treat Accessibly and its mission.

Such use may occur without further notice or compensation to the participant.

11.3 Participant Content

Where participants voluntarily provide photographs, videos, testimonials or other content relating to the Program, participants retain ownership of such content but grant Treat Accessibly a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, edit, publish, distribute and display such content for Program administration, promotion, reporting and future communications.

11.4 Minors

Treat Accessibly recognizes that the Program celebrates families and children.

Participants must not submit photographs, videos or other content depicting a child under the age of majority unless the participant is the child's parent or legal guardian or has obtained the express consent of the child's parent or legal guardian.

11.5 Withdrawal of Consent

A participant may request that Treat Accessibly discontinue future use of a specific photograph, video or testimonial by contacting Treat Accessibly in writing.

Treat Accessibly will make reasonable efforts to honour such requests for future uses; however, participants acknowledge that materials already published, distributed, shared with media outlets, or incorporated into printed materials, reports or third-party publications may not be capable of being withdrawn or recalled.

11.6 No Obligation to Publish

Treat Accessibly is under no obligation to publish or use any Publicity Materials and reserves the right to edit, refuse, remove or discontinue the use of any content at its sole discretion.

12. Privacy

Treat Accessibly is committed to protecting the privacy of all Program participants and will collect, use, store and disclose personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and Treat Accessibly's Privacy Policy, as amended from time to time. By submitting a Nomination or participating in the Program, participants consent to Treat Accessibly collecting and using personal information reasonably necessary to administer the Program, including, without limitation:

processing Nominations and Program registrations;
communicating with Street Captains and Homeowner Participants;
administering Program Support and reimbursement;
coordinating participation and Program activities;
evaluating Program participation;
responding to participant inquiries;
promoting and reporting on the Program, where consent has been provided or is otherwise permitted by law; and
complying with legal and regulatory requirements.

Participants acknowledge that certain personal information, including names, email addresses and other contact information, may be shared with the applicable Street Captain where reasonably necessary to coordinate participation on a Participating Street. Street Captains agree to use such information solely for Program administration and not for any other purpose.

Treat Accessibly does not sell, rent or trade participants' personal information to third parties.

Treat Accessibly may disclose personal information to trusted service providers, contractors, sponsors or professional advisors who assist in administering the Program, provided such parties are subject to appropriate confidentiality obligations and use the information only for authorized Program purposes.

Participants may request access to, correction of, or information regarding the personal information maintained by Treat Accessibly by contacting the Program using the contact information provided in these Terms or in the Treat Accessibly Privacy Policy.

Additional information regarding Treat Accessibly's privacy practices is available in the Treat Accessibly Privacy Policy, which is incorporated into these Terms by reference.

13. Program Communications

By participating in the Program, participants consent to receiving communications from Treat Accessibly relating to the administration of the Program, including selection notifications, participation requirements, reimbursement instructions, reminders and post-program reporting. Participants may also opt in separately to receive future communications from Treat Accessibly. Refusing marketing communications will not affect Program participation.

14. Sponsors

The Treat Accessibly Halloween Streets Program is made possible through the generous support of corporate sponsors, community partners and other organizations (collectively, the "Sponsors").

Sponsors may provide financial contributions, products, services, promotional support or other assistance to the Program; however, Sponsors do not own, administer, manage or operate the Program and do not direct or control the activities of participants.

Participation in the Program does not create any employment, agency, partnership, joint venture or contractual relationship between any participant and any Sponsor.

Nothing in the Program or these Terms shall be construed as an endorsement by a Sponsor of any participant, Participating Street, Street Captain or Homeowner Participant, nor as an endorsement by any participant of any Sponsor or its products or services.

To the fullest extent permitted by law, the Sponsors shall have no responsibility or liability for:

the administration or operation of the Program;
the conduct or actions of any participant;
activities occurring on private or public property in connection with the Program;
personal injury, property damage or other losses arising from participation in the Program; or
any dispute between Treat Accessibly and a participant.

Any questions, concerns or claims relating to the Program shall be directed solely to Treat Accessibly and not to any Sponsor. Treat Accessibly reserves the right to add, remove or substitute Sponsors at any time without prior notice, provided that such changes do not materially affect the operation of the Program.

Treat Accessibly will not make introductions or connect any Street Captains or Program Participants with Sponsors as related to or outside the Program.

15. Assumption of Risk, Release Disclaimer and Indemnity

15.1 Voluntary Participation and Assumption of Risk

Participation in the Program is entirely voluntary.

Each participant acknowledges and agrees that participation in the Program, Halloween activities, and any activities associated with the Program occurs entirely at the participant's own risk.

Each participant is solely responsible for determining whether participation is appropriate and for ensuring that their property, residence, Accessible Treat Station, decorations, equipment, walkways, lighting, activities and participation are safe and suitable for all persons attending or visiting their property.

Participants acknowledge that participation in the Program may involve inherent and unforeseen risks, including, without limitation:

personal injury or death;
slips, trips and falls;
allergic reactions;
illness or disease;
property damage;
theft or vandalism;
vehicle or pedestrian incidents;
weather-related hazards;
interactions with members of the public;
criminal acts or misconduct by third parties;
accessibility-related incidents;
crowd management issues; and
any other known or unknown risks associated with Halloween activities or participation in the Program.

Each participant voluntarily assumes all such risks, whether known or unknown, foreseeable or unforeseeable.

15.2 Independent Participation

Participants acknowledge that Treat Accessibly does not own, occupy, control, supervise, inspect, maintain or manage any Participating Street, Participating Home or Accessible Treat Station.

Treat Accessibly does not organize, supervise, direct or control the activities of participants, visitors or members of the public attending any Participating Street.

Each participant remains solely responsible for their own conduct, property, activities and decisions.

15.3 Release of Liability

To the fullest extent permitted by applicable law, each participant, on behalf of themselves and their heirs, executors, administrators, successors and assigns, irrevocably releases and forever discharges Treat Accessibly, PADULO X INC., the Founding Family, Sponsors, community partners, affiliates, directors, officers, employees, contractors, volunteers, agents, the media, social media content generators and representatives (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses of every kind arising out of or relating to participation in the Program, except where such liability cannot legally be excluded. Participants acknowledge they have had sufficient opportunity to review these Terms and seek independent legal advice before participating.

15.4 No Responsibility

Without limiting any other provision of these Terms, Treat Accessibly, PADULO X INC., the Founding Family, Sponsors and the Released Parties assume no responsibility or liability whatsoever for:

any injury, illness or death;
any damage to real or personal property;
any theft, vandalism or criminal activity;
any acts or omissions of participants or third parties;
any disputes between neighbours or participants;
any accessibility-related incident;
any municipal or bylaw enforcement matter;
any weather-related event;
any failure by a participant to comply with applicable laws or Program requirements; or
any loss, claim, damage, cost or expense arising from or relating to participation in the Program.

Participants acknowledge that Treat Accessibly's role is limited to administering the Program and providing Program Support, and that all Halloween activities are organized and undertaken independently by participants.

15.5 Responsibility for Property and Conduct

Each participant remains solely responsible for:

their own residence and property;
any Accessible Treat Station established at their residence;
the safety of persons attending or visiting their property;
compliance with applicable laws, bylaws and regulations; and
their own acts, omissions and conduct.

Participation in the Program does not create any duty of care between neighbours or participants, nor does it make any Street Captain or participant responsible for the conduct, property or activities of another participant.

15.5 No Inspection or Certification

Treat Accessibly does not inspect, certify, approve or warrant the safety, accessibility or suitability of any Participating Street, Participating Home or Accessible Treat Station. Any Program Materials, signage, recognition or participation in the Program shall not be interpreted as a representation or warranty by Treat Accessibly that any location is safe, compliant with applicable laws or regulations, or suitable for any particular individual. Each participant remains solely responsible for the condition, safety, accessibility and operation of their property and activities.

15.6 Insurance

Participants are responsible for determining whether they maintain appropriate homeowners' or tenants' insurance. They remain responsible for maintaining appropriate insurance coverage for their property and participation. Treat Accessibly does not provide insurance coverage for participants.

15.7 Indemnification

Each participant agrees to fully defend, indemnify and hold harmless the Released Parties from and against any and all claims, actions, liabilities, damages, judgments, fines, penalties, costs and expenses (including legal fees on a solicitor-and-client basis) arising from or relating to:

the participant's acts or omissions;
their property or Accessible Treat Station;
any injury, death or property damage occurring on or relating to their property;
any breach of these Terms;
any violation of law; or
any claim brought by any third party arising from or relating to the participant's involvement in the Program.

This indemnity survives the participant's withdrawal from or termination of the Program.

16. Limitation of Liability

To the fullest extent permitted by applicable law, the Released Parties shall not be liable for any claim, demand, action, cause of action, loss, liability, damage, cost or expense of any kind whatsoever arising out of or relating to the Program, whether direct, indirect, incidental, special, consequential, exemplary, punitive or otherwise, including, without limitation:

personal injury, illness or death;
damage to, loss of or theft of real or personal property;
loss of income, profits, revenue, business or opportunity;
reputational harm;
emotional distress or mental anguish;
acts or omissions of participants, visitors or third parties;
incidents occurring on or relating to any Participating Street, Participating Home or Accessible Treat Station;
accessibility-related incidents or claims;
municipal enforcement actions or bylaw matters; or
any other loss or damage arising directly or indirectly from participation in, or in connection with, the Program,

except to the extent such liability cannot lawfully be excluded.

Without limiting the foregoing, the Released Parties shall not be responsible or liable for any delay, interruption, modification, suspension or cancellation of the Program, the withdrawal or reduction of Program Support, severe weather, natural disasters, public health emergencies, acts or omissions of third parties, criminal activity, supply shortages, transportation delays, utility or technology failures, municipal decisions, public safety concerns, or any other event or circumstance beyond their reasonable control.

Participants acknowledge and agree that Treat Accessibly's role is limited to administering the Program and providing Program Support. Treat Accessibly does not own, occupy, inspect, supervise, control, certify or warrant the safety, accessibility or suitability of any Participating Street, Participating Home, Accessible Treat Station or Halloween activity, and assumes no responsibility or liability arising from their condition, operation or use.

17. No Waiver of Statutory Rights

Nothing in these Terms limits, excludes or waives any rights or remedies that cannot lawfully be excluded or waived under applicable legislation.

18. Force Majeure

Treat Accessibly shall not be liable for any delay, interruption, modification, suspension or cancellation of the Program, or for any failure to perform its obligations under these Terms, where such delay, interruption, modification, suspension, cancellation or failure results from events or circumstances beyond its reasonable control.

Such events may include, without limitation: severe weather or natural disasters; fire, flood, earthquake or other environmental events; pandemics, epidemics or public health emergencies; war, terrorism, civil unrest or public disorder; labour disputes, strikes or work stoppages; government orders, laws, regulations or public safety directives; municipal restrictions or permit requirements; supply chain disruptions or shortages of products or materials; transportation or shipping delays; interruptions to utilities, telecommunications or technology systems; the withdrawal, cancellation or reduction of sponsor funding or Program support; or any other event or circumstance beyond the reasonable control of Treat Accessibly.

Where a Force Majeure event occurs, Treat Accessibly may, in its sole discretion and without liability:

postpone, suspend or cancel all or any portion of the Program;
modify the Program, including Program timelines, eligibility requirements, participation requirements, Program Support or reimbursement processes;
substitute, reduce or discontinue any Program Support; or
take any other action that Treat Accessibly considers reasonably necessary to administer the Program.

Participants acknowledge and agree that no compensation, damages, reimbursement or other remedy shall be payable by Treat Accessibly arising from any action taken in accordance with this Section.

19. General Provisions

19.1 Entire Agreement

These Terms, together with any documents expressly incorporated by reference, including the Treat Accessibly Privacy Policy and any Program guidelines or instructions published by Treat Accessibly, constitute the entire agreement between Treat Accessibly and each participant with respect to the Program.

These Terms supersede all prior or contemporaneous discussions, representations, understandings, negotiations, communications and agreements, whether oral or written, relating to the Program.

19.2 Severability

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19.3 No Waiver

No waiver by Treat Accessibly of any provision of these Terms shall be effective unless made in writing by an authorized representative of Treat Accessibly. A waiver of any breach or default shall not constitute a waiver of any subsequent breach or default.

19.4 Assignment

Participants may not assign, transfer or delegate any rights or obligations under these Terms without the prior written consent of Treat Accessibly.

Treat Accessibly may assign or transfer its rights and obligations under these Terms to any affiliated organization, successor, or entity administering the Program without participant consent.

20. Governing Law and Jurisdiction

These Terms and the Program shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any conflict of law principles.

Subject to any rights that cannot legally be waived under applicable law, the parties irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario with respect to any dispute, claim or proceeding arising out of or relating to these Terms or the Program.

If any provision of these Terms is determined to be invalid or unenforceable under the laws of a particular jurisdiction, that determination shall not affect the validity or enforceability of the remaining provisions of these Terms.

20.1 Good Faith Resolution

Before commencing any legal proceeding arising out of or relating to these Terms or the Program, the participant and Treat Accessibly agree to use reasonable efforts to resolve the matter through good faith discussions. Nothing in this Section limits Treat Accessibly's right to seek immediate injunctive or equitable relief where necessary to protect its intellectual property, confidential information, reputation or other legal rights.

21. Electronic Acceptance

By submitting a Nomination, registering as a Street Captain or Homeowner Participant, clicking an "I Accept" button, checking an acceptance box, replying electronically, or otherwise indicating acceptance of these Terms through any electronic means approved by Treat Accessibly, each participant:

acknowledges that they have read and understood these Terms;
agrees to be legally bound by these Terms;
confirms that they have the legal authority and capacity to enter into this agreement; and
agrees that such electronic acceptance constitutes their legal signature and has the same force and effect as an original handwritten signature.

Participants acknowledge that acceptance of these Terms is required both:

at the time a Nomination is submitted; and
again, if the Participating Street is selected, prior to accepting participation in the Program.

If a participant does not accept these Terms, they are not eligible to participate in the Program.

Participants agree electronic communications satisfy any legal requirement that communications be in writing.

22. No Professional Advice

Treat Accessibly provides information and resources for educational purposes only and does not provide legal, accessibility, engineering or safety advice.
